This Customer Agreement (this “Agreement”) contains the terms and conditions that govern your access to and use of the Service Offerings (NetPlay Cloud and NetPlay Cloud API) and is an agreement between Video Storm LLC (““we,” “us,” or “our”) and you or the entity you represent (“you” or “your”). This Agreement takes effect when you click an “I Accept” button or check box presented with these terms or, if earlier, when you use any of the Service Offerings (the “Effective Date”). You represent to us that you are lawfully able to enter into contracts (e.g., you are not a minor). If you are entering into this Agreement for an entity, such as the company you work for, you represent to us that you have legal authority to bind that entity.

Privacy Policy

You agree to Video Storm LLC privacy policy.

Acceptable Use of Service

NetPlay Cloud is intended to be solely used for the control and status monitoring of Video Storm products purchased by you.

The following actions are strictly forbidden:

• Attempting to access other users accounts, data, or systems
• Attempting to access any data not associated with your user account
• Storing any data with is not part of the NetPlay Cloud API
• Storing copywrite material, illegal data, or pornography in your NetPlay Cloud account
• Excessive data writes or reads which exceed reasonable limits

Video Storm LLC reserves the right to pursue legal action against you if your unacceptable use of the Service results in financial harm or business disruption.  You acknowledge that it is your responsibility to follow the terms of this agreement.

Account Termination

Your account and right to use NetPlay Cloud can be terminated by Video Storm LLC at any time and for any reason.  Generally this will only occur if you violate the terms of this agreement.  However, termination is at the sole discretion of Video Storm LLC and may not be challenged in any manner.

Video Storm also reserves the right to discontinue the NetPlay Cloud at its discretion.  We make no guarantees regarding service availability or continuation.

Fees

NetPlay Cloud is currently offered as a free service to you.  We reserve the right to convert customers to a paid service should we deem it necessary.  If we elect to convert your account to a paid service, you will have the opportunity to cancel your account prior to incurring any charges.

Copyrights

Storing your data on NetPlay Cloud immediately grants Video Storm LLC the right to use that data in whatever manner they choose.  Video Storm LLC makes no guarantees about your ability to retrieve or access any data stored on NetPlay Cloud.

Security

NetPlay Cloud is a service which allows control and status monitoring of your home electronics and network from the internet.  NetPlay Cloud uses commercially acceptable methods to prevent unauthorized access to your account, devices, or home network.  But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.  You agree to release Video Storm LLC from all liability regarding unauthorized use or access to your account or connected devices, regardless of how such use occurs.
